چکیده
در ماده 91 قانون مجازات اسلامی مصوب 1392، سه وضعیت به عنوان عوامل سقوط مجازات حد یا قصاص نوجوان بالغ معرفی شده‌اند: الف‌ـ عدم درک ماهیت جرم؛ ب‌ـ عدم درک حرمت جرم؛ ج‌ـ شبهه در رشد و کمال عقل. به قرینه مواد 144 و 155 این قانون می‌توان دریافت که مفاهیم «عدم درک ماهیت جرم» و «عدم درک حرمت جرم» در حقیقت ارتباط نزدیکی با مفاهیم «شبهه موضوعی» و «شبهه حکمی» در حقوق کیفری دارند. اما در عین قرابت معنایی این مفاهیم، مؤلفۀ «ادراک» یک وجه تمایز اساسی میان آن‌ها محسوب می‌شود که متفاوت از «علم» در ماهیت تعریف شبهه حکمی و موضوعی است. در حقیقت، قانون‌گذار با بیان مقولۀ «درک» در این ماده سعی نموده تا مفهوم نوینی را به مبانی حقوق جزای اطفال و نوجوانان بیفزاید که البته به سبب ابهام و نقص نظری، موضوع مجادله‌برانگیزی است. ادراک، مفهوم انتزاعی و پیچیده‌ای در دانش عصب‌روان‌شناسی است که از مقولات شناختی مغز و وابسته به عملکرد ذهنی می‌باشد. پژوهش حاضر در تلاش است تا این مفهوم را در قرائت دانش نوین حقوق عصب‌شناختی تبیین نموده و شاخص‌های احراز آن را مشخص نماید. یافته‌های این پژوهش علاوه بر اینکه تا حد قابل توجهی خلأهای علمی را در این زمینه برطرف می‌سازد، دیدگاه و معیارهای مناسبی در رابطه با ادراک کودک معارض با قانون به دادرس ارائه می‌دهد.
