چکیده
بوم‌زدایی به آسیب گسترده یا تخریب زیست‌بوم‌های یک قلمرو خاص اشاره دارد و در معنای حقوقی خاص، به تخریب محیط‌زیست در تعقیب اهداف نظامی و آسیب‌های زیست‌محیطی گسترده در طول جنگ اشاره دارد. از منظر جرم‌شناسی سبز، چالش اساسی این حوزه، جرم‌انگاری اقدامات افراد، شرکت‌ها، صنایع و دولت‌هایی است که با وجود شواهد علمی گسترده، به استمرار این مشکل کمک می‌کنند. برای غلبه بر چالش‌های زیست‌محیطی و جلوگیری از ارتکاب جنایاتی با وسعت و شدت بوم‌زدایی، تغییر رویکرد از سطحی‌نگری به ژرفانگری، مؤلفۀ اصلی جرم‌انگاری‌های داخلی و بین‌المللی است. از سوی دیگر، بوم‌زدایی محصول درک ارتباط عمیق و درهم‌تنیدۀ حقوق بشر و حفاظت از محیط‌زیست است؛ چراکه وضعیت اضطراری تغییرات اقلیمی و تنوع‌زیستی تهدیدکنندۀ حقوق بشر جهانی است. یکی دیگر از چالش‌های جرم‌انگاری بوم‌زدایی، اثبات حقایق و جمع‌آوری شواهد آسیب‌های شدید، بلندمدت و گسترده است، زیرا محیط‌زیست به خودی خود نمی‌تواند سخن بگوید و بزه‌دیده‌شناسی به دنبال تبیین و روشنگری آن، به‌مثابۀ طرف بالقوه یا موضوع حق است. این پژوهش توصیفی-تحلیلی، با استفاده از ابزار مطالعات کتابخانه‌ای و ترکیبی از براهین استقرایی و استنتاجی، به تبیین مبانی فلسفی، حقوق بشری، بزه‌دیده‌شناختی و جرم‌شناختی پرداخته و وضعیت کنونی بوم‌زدایی را بررسی کرده و امکان‌سنجی جرم‌انگاری آن را به‌رغم چالش‌های موجود در اساسنامۀ رم به‌عنوان پنجمین جرم، مورد ارزیابی قرار می‌دهد.
