چکیده
نهادینه‌‌سازی فرایندهای ‌‌ترمیمی ناظر به بزهکاری نوجوانان، با توجه به اهمیت کاهش نرخ تکرار جرم این اشخاص، در دهه‌‌های اخیر بسیار مورد استقبال سیاست‌گذاران قرار گرفته است. انگلستان و استرالیا از مهم‌ترین دولت‌‌هایی‌اند‌‌ که با نهادینه‌‌سازی فرایندهای ترمیمی ویژه در دل عدالت کیفری، حمایت ‌‌همه‌‌جانبه‌‌ای را برای توسعۀ اندیشۀ ترمیم ترتیب داده‌‌اند. بر این اساس، هدف مقالۀ حاضر آن است تا با مطالعۀ تطبیقی چگونگی نهادینه‌سازی فرایندهای‌‌ترمیمی ویژۀ نوجوانان بزهکار در این دو کشور و شناخت چالش‌‌هایی که در مسیر اجرایی آن شکل گرفته‌اند، دانش ‌‌تطبیقی لازم را در اختیار کشورهایی همچون ایران که در آستانۀ نهادینه‌‌سازی این فرایندهایند، قرار دهد. مقالۀ حاضر با استفاده از روش ‌‌تحلیل‌‌ تطبیقی، به‌‌ این یافته‌‌ها رسیده است که در انگلستان و استرالیا عدالت ‌‌ترمیمی به ‌‌معنای واقعی‌اش به‌ اجرا درنیامده‌‌ است. اگر همان محدودیت‌های‌ موجود در عدالت‌کیفری همچون کمبود منابع و زمان، تبعیض ‌‌نژادی، اقتدارگرایی و آموزش‌‌ ناکافی مجریان به ‌قوت خود در فرایندهای ‌‌ترمیمی باقی بمانند، جریان عدم‌کارآمدی عدالت کیفری بار دیگر تکرار خواهد شد. در نهایت، اگر کشوری بخواهد در نهادینه‌‌سازی فرایندهای ترمیمی ویژۀ بزهکاری نوجوانان موفق عمل نماید، شایسته ‌‌است به اصول ترمیمی پایبند بماند و با شناخت و حل‌‌ چالش‌‌های اجرایی، به عدالت ‌ترمیمی جایگاهی سزاوار ببخشد.
